Injury Accident Resulting in 4th Offense DUI at Sargent Road and Ashland Ave

On May 26, 2010 at approximately 0100 hrs, Sgt. Joe Kubicek observed a vehicle acting suspiciously on SW 32nd Road. As the deputy continued to observe the vehicle, it began to accelerate at a high rate of speed in an attempt to elude the deputy. The deputy continued to follow the vehicle without emergency equipment activated and located the 1992 GMC pickup at the intersection of Ashland Ave and Sargent Road where it had rolled. The suspect, Shawn D. Kyker, 32 of Plymouth, failed to negotiate the turn which resulted in the accident. Beatrice Fire and Rescue responded and transported Kyker to the Beatrice Community Hospital where he was treated and released.
After Kyker was released, he was arrested for the above charges and lodged at the Gage County Detention Center. The Nebraska State Patrol conducted the accident investigation and the Gage County Sheriff’s Office conducted the DUI investigation.
Responding agencies to the accident were the Gage County Sheriff’s Office, Nebraska State Patrol, Beatrice Fire and Rescue, and Beatrice Police Dept.
Seatbelts were not in use and alcohol is a factor in the accident.
